4. Subscription and Payments

Billing Cycle: Subscriptions are billed on a monthly basis. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

Auto-Renewal: By subscribing to the Service, you authorize us to charge your payment method on a recurring basis. You may cancel auto-renewal at any time through your account settings or by contacting our support team.

Payment Methods: We accept major credit cards and other payment methods as displayed during checkout. You represent and warrant that you are authorized to use the payment method you provide.

Price Changes: We reserve the right to change our subscription prices at any time. Any price changes will be communicated to you in advance and will take effect at the start of your next billing cycle.

7-Day Satisfaction Guarantee: We offer a 7-day satisfaction guarantee for new subscribers. If you are not satisfied with the Service within the first 7 days of your initial subscription, you may request a full refund by contacting our support team at support@byteslabs.cc. This guarantee applies only to your first subscription purchase and does not apply to subscription renewals or subsequent purchases.

Refund Policy: Except as provided under our 7-day satisfaction guarantee, all subscription fees are non-refundable. No refunds or credits will be issued for partial subscription periods, unused features, or account termination.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are solely responsible for all content you create, upload, or generate using the Service.

Prohibited Activities: You agree not to use the Service to:

• Create, distribute, or promote content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Generate content that infringes upon the intellectual property rights, privacy rights, or other rights of any third party
• Produce content depicting minors in any harmful, exploitative, or inappropriate manner
• Create deepfakes or synthetic media of real individuals without their explicit consent
• Generate spam, phishing content, malware, or other malicious materials
• Engage in fraud, impersonation, or misrepresentation
• Circumvent, disable, or interfere with security-related features of the Service
• Attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to the Service
• Use automated means, including bots, scrapers, or crawlers, to access or collect data from the Service without our express written permission
• Resell, redistribute, or commercially exploit the Service or any portion thereof without our prior written consent
• Violate any applicable local, state, national, or international law or regulation

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including removing offending content, terminating accounts, and reporting such violations to law enforcement authorities.

6. Intellectual Property Rights

Our Intellectual Property: The Service, including its original content, features, functionality, design, and underlying technology, is and remains the exclusive property of BytesLabs and its licensors. The Service is protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Your Content: Subject to these Terms and our Acceptable Use Policy, you retain ownership of any original content you create using the Service. By using the Service, you grant BytesLabs a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your content solely for the purpose of providing and improving the Service.

Generated Content: Content generated by our AI tools may be subject to additional terms. You are responsible for ensuring that your use of generated content complies with all applicable laws and does not infringe on the rights of any third party.

Trademarks: BytesLabs, our logo, and other marks are trademarks of BytesLabs. You may not use these marks without our prior written consent. All other trademarks, service marks, and trade names appearing on the Service are the property of their respective owners.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BYTESLABS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of, or inability to access or use, the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Any errors, mistakes, or inaccuracies in content generated by the Service
• Any interruption or cessation of transmission to or from the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT PAID BY YOU TO BYTESLABS DURING THE SIX (6) MONTHS PRIOR TO THE DATE THE CLAIM AROSE, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

8. Termination

Termination by You: You may terminate your account at any time by contacting our support team at support@byteslabs.cc or through your account settings. Upon termination, your right to use the Service will immediately cease.

Termination by Us: We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms of Service
• Violation of our Acceptable Use Policy
• Fraudulent, abusive, or illegal activity
• Non-payment of applicable fees
• Upon request by law enforcement or government agencies
• Extended periods of inactivity
• Technical or security issues
• Discontinuation of the Service

Effect of Termination: Upon termination, all licenses and rights granted to you under these Terms will immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
